There are some special limitations when naming a law firm or solo lawyer businesses. You must keep those in mind before starting your business, or you’ll suffer in the long run.
The limitations are:
1. The Model Rules of Professional Conduct
The American Bar Association (ABA) provides a set of ethical guidelines known as the Model Rules of Professional Conduct, which mentions how lawyers and law firms can represent themselves, particularly regarding firm names and letterheads.
Under Rule 7.5 of the ABA Model Rules, a law firm’s name must not be false or misleading. This means your firm’s name should accurately represent your practice without implying affiliations, partnerships, or expertise that doesn’t exist. For example, you shouldn’t use names or terms that suggest a connection to a government agency or another organization if no such connection exists.
2. Avoid Misleading Names
Here are key considerations to ensure your law firm’s name complies with ethical standards:
- No False Implications of Partnership or Association: If you’re a solo practitioner, avoid using terms like “Group,” “Firm,” “Partners,” or “Associates,” which could suggest that multiple attorneys practice at your firm when they do not.
- Using Names of Lawyers Not Associated with the Firm: Your firm name should not include the name of an attorney who is not actively practicing with you. Additionally, if a named partner becomes a judge or a public official, their name should be removed from the firm name to prevent any perception of undue influence or conflict of interest.
- Avoiding Governmental or Public Association: Do not use names or terms that imply a connection with governmental bodies or public agencies. For example, naming your firm “City Legal Services” could incorrectly suggest an affiliation with municipal legal services.
- Trade Names and Descriptive Terms: While some states allow the use of trade names, they must not be misleading. Avoid using superlatives or terms that cannot be factually substantiated, such as “Best Legal Firm” or “Top Criminal Defense Attorneys,” as they can be seen as misleading.
- Avoiding Legal Jargon or Confusing Terms: Steer clear of using complex legal terminology or Latin phrases in your firm name that clients might find confusing or intimidating.

Although the ABA Model Rules provide a foundational guideline, each state may have its own specific regulations regarding law firm names. Some key points to consider include:

– Specific Prohibitions: Some states may have unique prohibitions. For example, certain terms or phrases might be disallowed, or there might be restrictions on indicating firm size or practice areas in the name.
– Registration Requirements: You may need to register your firm name with the state bar or another regulatory body, especially if using a trade name.

As a lawyer, you already know that all your efforts will go in vain if the business name you chose is already trademarked. So conduct thorough trademark and legal checks to avoid potential disputes and protect your brand. A comprehensive trademark search helps prevent infringement claims, client confusion, and reputational damage. By registering your trademark at the federal or state level, securing your domain name, and consulting a trademark attorney, you can safeguard your firm’s identity and establish a strong, credible brand from the start.
To check if a trademark is already registered:
- Write down the exact name you plan to use for your business.
- If you’re in the USA, then visit the USPTO trademark search page.
- Keep the default General Search option, or play with other options.
- Search for your target business name.
- Review the results for any trademarks that exactly match your name.
- Search for Similar Names like:
- Alternate spellings
- Similar-sounding names
- Plurals or singular forms
- Abbreviations or acronyms
- For each matching or similar trademark:
- See what products or services the trademark is registered for.
- Ensure the trademark is “Live” (active) and not “Dead” (abandoned).
- Similar trademarks in unrelated industries may not pose a conflict.
